1. Introduction

This Privacy Policy explains how Santhiya Resorts & Spas (“Santhiya”, “we”, “us”, or “our”) collects, uses, discloses, stores, and protects your personal data when you register for and participate in the Santhiya Loyalty Program(“Program”).

By enrolling in or using the Program, you acknowledge that you have read and understood this Privacy Policy. This Policy should be read together with the Santhiya Loyalty Program Terms of Use and Terms & Conditions.

2. Data Controller

Santhiya Resorts & Spas is the data controller responsible for the processing of your personal data in connection with the Program, in accordance with applicable data protection laws, including the Personal Data Protection Act B.E. 2562 (PDPA) and, where applicable, the General Data Protection Regulation (GDPR).

We may use limited automated processing to personalise offers, analyse program usage, or determine membership tiers. Such processing does not produce legal or similarly significant effects on you. You have the right to object to such processing and to request human review where applicable.

13. Children’s Personal Data

The Santhiya Loyalty Program is not intended for individuals under the age of 18. We do not knowingly collect personal data from children. If such data is identified, it will be promptly deleted.

14. Security Measures

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, alteration, or disclosure. However, no system is completely secure, and transmission of data over the internet is at your own risk.

15. Personal Data Breach Notification

In the event of a personal data breach that poses a risk to your rights and freedoms, we will notify affected individuals and the relevant supervisory authorities without undue delay, and within the timeframe required by applicable law (including, where applicable, within 72 hours under GDPR).

If you believe that our processing of your personal data infringes applicable data protection laws, you have the right to lodge a complaint with the data protection authority in your country of residence.

These Terms of Use govern your participation in the Santhiya Loyalty ProgramSanthiya Loyalty Program (“Program”). By enrolling in, accessing, or using the Program, you agree to be bound by these Terms of Use, together with the Privacy Policy and Terms & Conditions.

1. Eligibility

The Program is available to individuals aged 18 years or older. Enrollment is subject to acceptance by Santhiya Resorts & Spas (“Santhiya”). Santhiya reserves the right to approve, reject, or cancel any application at its discretion.

2. Account Registration & Access

You are responsible for ensuring that all information provided during registration is accurate, complete, and up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

3. Use of the Program

The Program is intended for personal, non-commercial use only. Membership benefits may not be shared, transferred, sold, or used by any third party.

Santhiya reserves the right to suspend or restrict access to the Program in cases of misuse, suspected fraud, or violation of these Terms.

4. Communications

By participating in the Program, you may receive transactional communications related to your account, benefits, and Program updates.

Marketing communications will be sent only where consent has been provided, and you may opt out at any time without affecting your membership status.

5. Privacy & Data Protection

  • Are subject to availability and applicable blackout dates and conditions

2. Reservations & Redemption

Any applicable membership fees are non-refundable and non-transferable unless explicitly stated otherwise. Santhiya reserves the right to revise fees, benefits, or membership structures with prior notice.

4. Member Conduct

Members are expected to behave in a manner consistent with the standards of hospitality and guest experience upheld by Santhiya. Santhiya reserves the right to suspend or terminate membership in cases of:

  • Misconduct or abusive behaviour
  • Fraudulent activity or misuse of benefits
  • Violation of these Terms & Conditions or resort policies

5. Marketing Communications

With your consent, Santhiya may send you exclusive offers, updates, and personalised communications related to the Program. You may withdraw consent at any time without affecting your membership.

6. Privacy & Data Protection

Personal data collected as part of the Program will be processed in accordance with the Santhiya Loyalty Program Privacy Policy and applicable data protection laws.

7. Changes to the Program or Terms

Santhiya reserves the right to amend, suspend, or terminate the Program or these Terms & Conditions at any time. Where practicable, reasonable notice will be provided.

8. Termination of Membership

Santhiya may suspend or terminate a membership without refund in case of:

  • Breach of these Terms & Conditions
  • Fraud or abuse of Program benefits
  • Violation of applicable laws or resort policies

Members may request cancellation of their membership at any time, subject to applicable conditions.

9. Limitation of Liability

To the fullest extent permitted by law, Santhiya shall not be liable for any loss, damage, or injury arising from participation in the Program, except where caused by gross negligence or wilful misconduct.

10. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of Thailand, and the courts of Thailand shall have exclusive jurisdiction.
